RATON, NM - At approximately 2:31AM on January 18th, 2020, a Raton Police Officer observed a driver not coming to a complete stop at a stop sign and taking a wide turn. Soon after, the officer asked why the smell of alcohol was coming from the vehicle. The suspect told the officer that his passengers were the reason why he detected a strong odor of alcohol. After processing the information given to the officer, the suspect was asked to step out of the vehicle to perform a field sobriety test. During the horizontal gaze nystagmus test [out of frame, redacted] the suspect was unable to follow the officer's finger smoothly and had distinct nystagmus at maximum deviation. While the officer demonstrated how to perform the walk-and-turn test, the suspect began taking a step forward and had to be asked to return to the starting position. During the exercise, the suspect extended his arms out for balance. The suspect was unable to properly align his feet in a straight line while touching his heel with his toes. The officer next demonstrated how to perform the one leg stand test. The suspect again extended his arms out for balance and failed to stand straight while having a pronounced backward lean. Upon completion of the field sobriety test, the officer spoke with another responding officer and determined that the suspect was likely impaired. Following the discussion, the officer then reengaged the suspect and informed him that he was being arrested for driving while intoxicated (DWI). The officer asked the suspect again how much he had had to drink in the night and he admitted to drinking two alcoholic beverages "a long time ago." While in the patrol car, the suspect was given the opportunity to blow into a breathalyzer, but ultimately refused the offer which forced his license to be suspended for one year. The suspect was later charged with aggravated DWI.
