Want to read the police reports? Consider becoming a super supporter! Incident Information: On August 1st, 2024, Police in Macomb County Michigan were dispatched to a UDAA (Unauthorized Driving Away of an Automobile) complaint. While interviewing the victim, other deputies were in hot pursuit of the stolen vehicle, which failed to yield for a traffic stop. After tire deflating devices were used on a nearly 20 mile long pursuit, the driver loses control and bails on foot. As a result of this incident, David Anuscinski was charged with Unlawful Driving Away of an Automobile, Assault with a Dangerous Weapon, Fourth-Degree Fleeing and Eluding, Resisting and Obstructing, and a Habitual Offender 4th enhancement. David ultimately pleaded guilty. The fleeing and eluding and R&O charges were dismissed, and the habitual offender enhancement was removed. He was sentenced to 365 days in the Macomb County Jail, with credit for 35 days served, along with two years of probation and approximately $9,200 in fines and court costs. It should also be noted, David does have an extensive criminal history. We spoke with a small panel of MCOLES certified, sworn peace officers from the state of Michigan. All four advised if the videos accurately portray events, it is highly likely this use of force was excessive given the Graham factors. It is unclear why we had such troubles with the FOIA process on this incident.
