Avalon, NJ It should be noted the vehicle did not immediately pull over to the shoulder of the roadway and continued traveling westbound on Avalon Boulevard for approximately 50 Feet. Once the vehicle pulled over to the shoulder of the roadway, I exited my patrol vehicle and approached the passenger side window. At this time, I was able to speak to the driver Valerie. I advised Valerie the reason for the stop and that she was being recorded by my Body Worn Camera (BWC). I asked Valerie for her driver's license, registration, and proof of insurance. As Valerie was collecting her documents, I observed that her hand movements were slow and she appeared to be having difficulty finding her documents. I asked Valerie where she was coming from, and she replied "Avalon". While speaking to Valerie, her speech sounded slurred and slow. I also observed that her eyes were bloodshot/ watery, and her face was flush. Valerie handed me her documents, and I returned to my patrol vehicle. At this time, Ptl. DeCesero arrived on the scene. Ptl. DeCesero advised me that he had already spoken to Valerie earlier in the evening, and she agreed to leave her vehicle parked at the WaWa overnight due to her being intoxicated. (See Ptl. DeCesero's Supplemental report). At this time, Ptl. DeCesero approached the passenger side of the vehicle and began speaking to Valerie. He then approached the driver's side of the vehicle and asked her to step out of the vehicle to conduct standard field sobriety testing. When Valerie exited the vehicle, I observed her swaying from left to right in a circular motion while walking toward me. The shoulder of the roadway was illuminated by my patrol vehicle headlights, patrol flashlight, and continuous streetlights. It should be noted I turned off my front-facing emergency lights while conducting the tests as to not distract Valerie. Prior to Valerie starting the test, I explained and demonstrated each test to her, and she advised me she understood the instructions. Based on my observations, I advised Valerie to place her hands behind her back and advised her that she was under arrest for driving while intoxicated. I handcuffed (double locked and checked for fit) Valerie and escorted her to the rear passenger compartment of my patrol vehicle. I utilized the back of my hand to search Valerie prior to placing her in the rear compartment. The rear passenger compartment was searched and found clear of any contraband prior to placing Valerie inside. I fastened Valerie's seatbelt. I advised dispatch of my starting mileage and began transporting her to police headquarters. I also advised dispatch to have a tow truck respond to my location for John's Law. Moments later, dispatch advised me that ANA Towing was responding. Ptl. DeCesero searched the vehicle for intoxicants. Ptl. Byrd arrived on the scene and stayed with the vehicle until the tow truck arrived on the scene. While transporting Valerie to Police Headquarters, I detected a strong odor of an alcoholic beverage emanating from the rear passenger compartment of my patrol vehicle, which was not present prior to placing Valerie inside. Upon my arrival at Police Headquarters, I parked in the parking lot and escorted Valerie to the processing room. I secured Valerie to the processing room bench with a single handcuff (double locked and checked for fit). At this time, Sgt. Robinson began reading Valerie the standard statement for providing breath samples. Valerie said "No" to providing breath samples. Sgt. Robinson then read Valerie her Miranda Rights, and she invoked her rights. While processing Valerie, she began to ramble on that she worked for a law firm and that we were going to pay. Valerie continued to ramble about her working at a law firm for the duration of the processing phase. Valerie was issued the following summons: Driving while Intoxicated Refusal to Submit to Breath Testing Lights required ______________________________________________ All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. This channel is made strictly for educational and news gathering purposes.
