CCTV surveillance and body camera video from the Minneapolis Police Department of the officer involved shooting of Marcus Terrell Fischer. Location: Minneapolis, Hennepin County, Minnesota, United States Date: December 18, 2017 (Monday) STATEMENT OF PROBABLE CAUSE: Your complainant is a special agent with the Minnesota Bureau of Criminal Apprehension and in that capacity has investigated and learned the following: On December 18, 2017 in the afternoon, Minneapolis police officers arrested Marcus Terrell Fischer (DEFENDANT) while he was working at the Mall of America. The defendant was arrested for probable cause first degree aggravated robbery and first degree assault for allegations that the defendant had arranged to purchase a pistol and when he met with the seller he shot the seller in the chest and fled. Once police apprehended the defendant, he was pat-searched per Terry twice by officers from the arresting unit. Despite the two pat searches, the defendant was able to secrete on his person an approximately 4 inch folding knife in his waist band of his trousers. The defendant was brought to the Minneapolis police headquarters in downtown Minneapolis, Hennepin County, Minnesota. There the defendant was brought to an interview room in the criminal investigators office room 108 of Minneapolis City Hall. Upon arrival the defendant was escorted into interview room M where he met with Minneapolis police detective sergeants Gene Suker and Kelly O'Rourke. Detective Suker and O'Rourke interviewed the defendant per Miranda and obtained enough information about the previous robbery/assault allegations that they determined to hold the defendant for charges. After explaining that he was in custody for those offenses, the defendant was asked if he wanted anything and the defendant asked for water. Sergeant O'Rourke left the interview room along with Sgt. Suker and upon leaving they soon discovered that the defendant reached into his trousers and retrieved a 4 inch folding knife. The defendant opened the knife and began repeatedly stabbing himself first in the neck then his chest. When Sgt. O'Rourke returned with a bottle of water he opened the door to the interview room and discovered the defendant stabbing himself and blood strewn throughout the room. Sgt. O'Rourke immediately yelled for the defendant to drop his knife but the defendant refused. Sgt. Suker called for squad cars and an ambulance to assist. No one in police headquarters at the time possessed an electronic stun gun to incapacitate the defendant. ...[This portion described the events that followed (as seen in the body camera video). The defendant was taken to Hennepin County Medical Center with two gunshots, multiple stab wounds to his neck and chest area as well as a gaping wound to his throat caused by the defendant sawing at his throat to his trachea with the blade of the knife. Thanks to the surgeons at Hennepin County Medical Center, the defendant was within days brought to the Hennepin County Jail where he awaits trial on the earlier robbery/ assault charges. While in the hospital the defendant was interviewed and said that he recalled being pat searched twice before arriving at the interview room at police headquarters. He said he hid his knife in the waist of his trousers and brandished it because he did not want to go to jail. He further acknowledged being repeatedly warned to drop his knife but said he did not because he didn't want to go to jail. The defendant also said that he knew if he did not drop his knife that officers would shoot him. He admitted that as he came toward the police he knew they would shoot him and that he "Could've taken a better path".
