On November 1, 2023, Deal Police Officer Velasquez observed a vehicle failing to maintain a single lane. Officer Velasquez activated her emergency lights and siren in an attempt to initiate a traffic stop. The driver of the vehicle, a 39-year-old woman, stopped in the middle of the left lane of traffic. Even after admitting that she consumed alcohol, Officer Velasquez allowed the woman to drive the vehicle over to the right-hand curb. The driver was then asked to step out of the vehicle in order to perform standardized field sobriety tests (FSTs). She was very reluctant to exit the vehicle, claiming that she did not trust the police. Officer Losquardo arrived and ordered the woman out of her vehicle under threat of arrest. The woman exited her vehicle and performed the FSTs. At the conclusion of the tests, she was placed under arrest for Driving While Under the Influence (DWI). She was transported to the Deal Police Station, where she submitted to a breath alcohol test. The result was 0.156% BAC, nearly twice the legal limit. She received citations for DWI, Reckless Driving, Careless Driving, Traveling on Marked Lanes, and Having No Insurance. Her case is in a "held" status due to a statewide legal challenge with the evidential breath testing device used.
