***Re-upload to comply with YouTube policies*** Official report summary: On October 28, 2024, at 1135 hours, I, Officer Christian Ross (P683) with the Florida Fish and Wildlife Conservation Commission was on duty in uniform in my state issued patrol vehicle. I was conducting patrol in the Melbourne Beach area of Brevard County, Florida. I was dispatched to a call for service in reference to a subject keeping an Atlantic Green Turtle in a fish tank at his residence. I responded to 4205 South A1A APT B, Melbourne Beach, Florida. On my way to the residence, I spoke with (redacted) having knowledge of (redacted) Rudell Mason Brice, identified by his Florida driver license (FL DL: B620733621000) in possession of a sea turtle he found. was able to provide photographs and video of the turtle. Upon arrival, Mr. Brice was not at his residence. I spoke with a gentleman working on the property. The male Walter Alianell identified by his Florida driver license (FL DL: A454901653840) stated he knew Mr. Brice as he has seen him coming and going from the residence. I asked Mr. Alianell to take me to the back porch area, he walked me to where they were remodeling and in plain view I could see an aquarium. I walked up to the aquarium with Mr. Alianell and observed a small turtle swimming in the water. I took photographs and contacted Turtle Biologist Sue with FWC; after providing the picture she confirmed the turtle was an Atlantic Green Seat Turtle. I obtained a phone number for Mr. Brice from Mr. Alianell. While on my way back to my vehicle I met Mr. Dustin Heaberlin identified by his Florida driver license (FL DL: H218937997000). Mr. Heaberlin also lives at the apartment complex and stated he knew about the turtle. Mr. Heaberlin stated, Mr. Brice found the turtle in his garage approximately a week ago. I walked back to my vehicle and attempted to call Mr. Brice. I was met with negative results. While I was attempting to call Mr. Brice, Mr. Heaberlin had called Mr. Brice and brought the phone to me. I spoke with Mr. Brice on the phone. After I introduced myself, Mr. Brice told me that he found the turtle in his garage and did not know what to do with it, so he kept it in an aquarium. I explained to Mr. Brice that he could not keep an Atlantic Green Sea turtle. Mr. Brice advised he planned on taking it to the turtle rescue center or releasing it to the ocean when his son arrived. Mr. Brice stated his son would not be with him until the summertime. While I was speaking to Mr. Brice, he told me I could take the turtle to the rescue center. I requested Mr. Brice return to his residence so that he could fill out a sworn written statement and sign paperwork. While I was waiting for Mr. Brice to arrive, I took possession of the turtle and contacted the turtle biologist with FWC. The biologist coordinated with the Brevard Zoo as they are familiar with rehabilitating turtles as hatchlings. I placed the turtle in a damp towel to keep it moist as instructed by the zoo veterinarian. Once Mr. Brice arrived, I read him the Miranda warnings on the witness statement and asked him to fill it out with his side of the story. Once he completed the statement I issued Mr. Brice a Notice-to-appear resource citation 392405C in violation of Florida state statute 379.407(2)(e)5- taking, harvesting, or possession of a species, which are endangered, threatened, or of special concern- Atlantic Green Turtle. Mr. Brice signed the citation and advised he would make the court date issued to him. I took the turtle to the Brevard Zoo and met with the veterinarian Jessica. Jessica stated the turtle appeared to be approximately a week old as the under belly was still soft. After I left the zoo, I provided the address to the FWC biologist Sue so that she could coordinate with the residence to make sure they have the proper fixtures to prevent further turtles on their property. All incidents occurred in Brevard County, Florida. All incidents were recorded on my state issued Body Worn Camera. All photographs were taken with my state issued iPhone and Mr. Brice cellphone. The turtle was turned over to the Brevard Zoo veterinarian for rehabilitation.
