-Volusia County, FL. -November 19, 2024. Parents attack the School Resource Deputy at Deltona Middle School on Tuesday, 11/19/24. Jorge Rivera and his wife Dagmarie Aponte Iturrino are both in custody at the Volusia County Branch Jail. A Deltona husband and wife were arrested Tuesday accused of attacking a school resource deputy at Deltona Middle School because they did not like that she filed a battery charge against their son, the Volusia County Sheriff's Office said. Jorge Rivera, 46, was also charged with a hate crime because he called the deputy a derogatory slur making reference to the deputy's sexual orientation before he punched her in the head, the sheriff's office said. Rivera was in the Volusia County Branch Jail on Wednesday without bail charged with battery on a law enforcement officer, trespassing on school property after warning, disruption of school function, and assault or battery on specified officials or employee. Rivera was charged with robbery with a weapon, grand theft of $750 but less than $5,000 and resisting arrest with violence for taking away the deputy's taser. His wife, Dagmarie Aponte Iturrino, 45, was charged with battery on a law enforcement officer, resisting arrest with violence, disrupting a school function, and trespass on school property after warning. She is out of jail on $11,000 bail. Investigating deputies said that the school resource deputy filed a battery charge on the couple's son on Monday after he pushed a girl. So, Rivera and Aponte showed up at school Tuesday morning to protest the charge. The parents did not like the outcome of the meeting, so Rivera became irate, started screaming at the deputy and was asked to leave. In the hallway, Aponte pushed the deputy against a wall. Rivera then punched the deputy in the head, and knocked her to the ground, deputies said. Rivera then ripped the deputy's taser from her hand but the deputy was able to stand up, draw her firearm and told him to drop the taser. Rivera and his wife were handcuffed. The deputy was treated on scene and taken to the hospital because she displayed symptoms of concussion, the sheriff's office said. The attack on the school resource deputy occurred in the presence of their son, prompting a reaction from Sheriff Mike Chitwood. “If you’re wondering why some kids show no fear of consequences in today’s society, look no further than these parents as Exhibit A,” Chitwood said. “I’m glad they’re locked up, and I look forward to them being held fully accountable for this blatant attack on our deputy who was just doing her job."
