WAUKEGAN, IL - On January 10th, 2020 at 8:54PM, Waukegan police responded to a car crash outside a local bar. Once inside, the officer located the suspect who was the driver of the vehicle and began questioning him. The suspect claimed that the crash was caused primarily due to the weather conditions and admitted that he was at fault. The suspect also claimed that he did not have a license or insurance whereupon the officers arrested him. While in custody, the suspect was transported to a police cruiser then was transferred to another vehicle to be transported to the Waukegan Police Department. The suspect hit his head while entering the initial squad car and sustained a cut on the side of his face. At the police department, the suspect was questioned on whether he had any medical or physical issues that would prevent him from performing a field sobriety test. After the suspect told the officer that he did not have any reservations in taking the tests, he was read his Miranda rights. The suspect verbally told the officer that he understood his rights. The suspect then became combative and when informed by the officers that by not performing the field sobriety test that that would be considered a refusal, he agreed to perform the tests. The suspect informed the officers that he did not have any vision problems and no other issues that would affect his ability to perform a horizontal gaze nystagmus test, but still became argumentative. The officer asked the suspect how many fingers he had up from a distance farther than where he would be holding the pen and the suspect answered correctly. During the exercise, the suspect was observed having posture indicative of impairment. The suspect was unable to follow the pen smoothly, moved his head to track the object, and had distinct nystagmus at maximum deviation. At times, the suspect began laughing due to having difficulty focusing and following the directions. The officer next instructed the suspect on the walk-and-turn test. The suspect struggled to follow instructions in real-time and asked several questions before the officer could explain. During the exercise, the suspect struggled to balance and keep his feet straight. The suspect again had difficulties performing the one leg stand test as he showed significant signs of impairment by not being able to balance, follow instructions, nor count properly. The suspect claimed that the officers were asking him to count backwards even after he performed the entirety of the test counting forwards. When asked to estimate the passage of 30 seconds (Romberg test), the suspect claimed that he could not do math to which the officer responded, "That's not math, that's counting." The suspect then asked if he could count in Spanish. He was informed that he would be counting in his head. The suspect stopped the test after the passage of 18 seconds. The suspect struggled to perform the finger to nose test by repeatedly opening his eyes and accused the officers of administering the test such that he would fail. The suspect then proceeded to touch his nose with the incorrect finger on the last two iterations. When asked to submit an evidentiary breath alcohol sample, the suspect refused several times and was informed that if he refused he would likely have far more dire consequences than complying. Since he did not currently have a license, the officers told him he could potentially never have a license again in the State of Illinois. The suspect then admitted to drinking earlier in the evening and was charged with several vehicle traffic law violations, leaving the scene of an accident, and driving under the influence (DUI).
