On January 23rd, 2026, Flagler County Sheriff's deputies responded to a hit-and-run in Palm Coast, Florida, where an elderly man on an ebike was struck in a crosswalk by a white Mazda SUV. The driver fled the scene. Using street camera footage and license plate identification, officers traced the vehicle to a registered address within minutes — and eventually identified the likely driver as Andre Matanga, a 38-year-old man with documented mental illness. What followed raised serious legal questions: a Miranda advisement delivered through a family phone interpreter to a non-English speaking suspect, a warrantless entry into a private residence, and multiple Taser deployments against a 413-pound individual with schizophrenia. In this analysis, we examine the constitutional issues involved, the applicable Florida statutes, and evaluate the conduct of all parties against established legal and tactical standards. All suspects are presumed innocent until proven guilty in a court of law. CHARGES FILED (Andre Matanga): • Leaving Scene of Crash w/ Injury — FL § 316.027 • Battery on Law Enforcement Officer — FL § 784.07 • Resisting Arrest with Violence — FL § 843.01 • Resisting Without Violence — FL § 843.02 LEGAL STANDARDS CITED: • Miranda v. Arizona (1966) • Graham v. Connor (1989) • Payton v. New York (1980) • Florida v. Bostick (1991) DISCLAIMER: This video is for educational and informational purposes only. All analysis reflects publicly available legal standards and does not constitute legal advice. All individuals are presumed innocent until proven guilty. #bodycam #police #legalanalysis #policecam
