On March 19, 2025, Las Cruces Police Officers responded to a call involving a possible drunk driver. Officer Dutton arrived first to find a woman exiting her vehicle. The fire department also arrived at about the same time. The 44-year-old woman claimed she was driving herself to the hospital to sober up and detox. Once the fire department medically cleared the woman, Officer Dutton initiated a DUI investigation. The woman refused to perform field sobriety testing and she refused to submit to a breath test. She was arrest for Aggravated DUI and was transported to the Las Cruces Police Department before being eventually taken to the Dona Ana County Detention Center. Online court records indicate the charge was dismissed by the prosecutor several months later.
