On April 13, 2024, assistance was provided to the U.S. Coast Guard (USCG) aboard a marked CG vessel, 29199, as part of an operation focused on Boating Under the Influence (BUI). The vessel was operated by a BM1, with an assistant operator BM3, along with a BM2 and an MK3 onboard. While observing a large number of boaters at John’s Pass sandbar, an operator of a Sea-Doo was seen rapidly accelerating within close proximity to two other jet ski operators in a slow-speed zone. The USCG operator attempted to contact the individual, activating the siren twice, but the operator did not respond. The violator was eventually advised by one of the other jet ski operators that a stop was being conducted, at which point he brought the vessel to a stop, despite having turned and seen the authorities beforehand. Upon making contact, the operator was asked how he was doing and responded with either “Ocean” or “Oh shit.” During the interaction, it was noted that the operator’s personal flotation device (PFD) was not properly secured. While speaking with him, his responses appeared inconsistent and confusing. He initially stated that he had just purchased the Sea-Doo and recently moved to the area, but later contradicted himself by claiming he had owned it for two and a half years. Additionally, he mentioned telling his sons that his behavior was reckless, but when asked about the other jet ski operators, he claimed they were recently met friends rather than his sons. Throughout the conversation, he frequently stopped mid-sentence without completing his thoughts. The operator stated that he was sixty-two years old and acknowledged that he “shouldn’t be acting stupid.” He repeatedly admitted to “acting stupid” and stated, “I was driving too fast.” He also mentioned that it was his first time operating the Sea-Doo on the “lake.” A boating safety inspection (BSI) was conducted, during which he was asked to provide his driver's license and vessel registration. He initially handed over a piece of paper that was not his registration and had to be reminded to retrieve his identification. When asked about his time of arrival at the sandbar, he hesitated and did not respond, despite previously stating he had arrived about two and a half hours earlier. He continued making statements about “acting stupid” and mentioned that he had told his friends earlier that he was not going to draw attention to himself, yet did so anyway. During the inspection, he was reminded to retrieve the required sound-producing device (whistle). While inspecting the fire extinguisher, he failed to follow instructions, pulling the pin out instead of ensuring it was properly secured. An odor of an alcoholic beverage was detected emanating from his breath and person. When questioned about alcohol consumption, he initially paused before responding, stating, “Probably one too many,” then changed his answer to “Two.” He followed up by saying that he had fasted and not eaten anything. The operator agreed to perform Standardized Field Sobriety Tasks (SFSTs). While onboard, he spontaneously admitted to having “a couple of cocktails.” During pre-task questioning, he denied being under the care of a doctor or dentist but later stated he was taking medication, though he insisted it would not affect his performance on the SFSTs. Based on all observed behaviors and his performance during the SFSTs, he was placed under arrest for boating under the influence of an alcoholic beverage to the extent that his normal faculties were impaired beyond safe vessel operation. Throughout the investigation, he remained cooperative and compliant. A breath sample was obtained, yielding results of .057/.059 blood alcohol content. His vessel was released to a friend, and he was transported by Pinellas County authorities to the Pinellas County Jail without further incident.
