EUSTIS, FL - At 9:32PM on February 10th, 2020, Eustis Police responded to concerned Dollar General employees who witnessed a man crashing into a curb and walking inside to call his mother. The responding officer arrived at the store and asked the suspect to hang up the phone and show identification. Once outside, the officer questioned the suspect who claimed he was coming from work. The suspect admitted to driving into the store parking lot because his car experienced mechanical issues while traveling home. The suspect did not believe he had hit anything and attempted to drive to a gas station to repair a flat tire. The suspect admitted to drinking two alcoholic beverages roughly five hours prior to the issues that occurred with his vehicle. When the second officer arrived, he investigated how the vehicle was parked. The officer discovered that the vehicle had jumped the curb and that the car was still in gear with the wheels turning. The suspect admitted to having driven over the curb and earlier having been trying to free the now-stuck vehicle with no success. At one point, the suspect asked the officers how long they were following him before being pulled over to which the officer informed him that he had not been stopped by the police. The second responding officer began taking witness statements from the store employees who claimed to have heard a loud boom then saw the suspect lose a tire. The store employees claimed that in response the suspect kept revving up the vehicle. At the beginning of the field sobriety test, the officer asked the suspect if he had any medical issues that would have prevented him from performing field sobriety tests. The suspect responded that he only had a medical issue that would not affect his performance. During the horizontal gaze nystagmus test, the suspect was unable to smoothly follow the officer's stimulus and nystagmus was observed at maximum deviation. The suspect was asked to continue to look at the stimulus after he had looked down at the officer's notepad. After this exercise, the second responding officer administered the remaining tests. The suspect proceeded to perform the walk-and-turn test. The officer observed the suspect being unable to follow instructions. The suspect lost balance while standing in the starting position and continued to get out of the starting position while the officer was explaining the remainder of the test. The officers observed the suspect taking 14 steps forward and 13 steps on the way back. The suspect did not touch heel to toe on several steps, did not remain on the red line, and did not count his steps out loud. While performing the one leg stand test, the suspect initially did not have his leg straight, did not count, and extended his arms for balance. The suspect also believed that he had to lift his foot off the ground for six seconds instead of six inches. The officer then reinstructed the suspect for another attempt. During the second attempt, the suspect was unable to balance for any length of time and counted to four only once. The suspect again had to extend his arms for balance and displayed a significant leaning posture throughout the test. The officer then instructed the suspect on performing the finger to nose test. While performing the test, the officer observed several signs of impairment including the suspect leaning his head forward, failing to return his hand to the down position after touching his nose, and not touching the tip of the nose when prompted to touch. Following this test, the officers arrested the suspect for driving under the influence (DUI). After being arrested, the suspect made several requests that included being able to smoke a cigarette and contacting his mother. A search of the suspect's person did not yield any illegal paraphernalia, but officers did find a bag of what they believed contained trace amounts of heroin, however, the man was not charged with any additional offenses. The man later blew a .01% BAC at the station, but would later provide a chemical urine sample for drug analysis.
