One of the officers reports On November 2, 2023, at approximately 8:00 p.m., I, New Mexico State Police (NMSP) Crime Suppression Unit (CSU) Elizardo Romero (Albuquerque) was on duty, in my official capacity. I was in my assigned New Mexico State Police unit. A black in color Hyundai Santa Fe bearing a Texas Registration which returned to a different vehicle. 2nd DA Investigators had obtained a Cell Phone Ping Search Warrant for Joshua’s cell phone and at the time of this incident pings were consistently pinging at the above address. The vehicle was located in the same area of phone pings for a fugitive from justice identified as Joshua Candelaria who had multiple warrants for armed robbery. The vehicle was parked at 9507 Candelaria Rd NE, Albuquerque, NM 87112, at the splash n dash car wash. While the vehicle was occupied a high-risk felony stop was conducted. During the high risk felony stop a unknown female who was in the driver seat placed the vehicle into reverse attempting to a drive away. the female then placed drive and struck a marked police unit. The female then exited the vehicle, and ran away. While the high risk felony stop was being conducted Joshua was seen in the front passenger seat and he jumped over the center console and occupied the driver seat taking control of the vehicle had having the vehicle in drive. While in the driver seat he kept reaching around his waste band and the back seat area while continuously disobey multiple commands. While this Joshua was sitting in the driver seat I could see that there was no persons in the rear passenger side seat. I also noticed that all windows were up on the vehicle. To create a communication port as well as a distractionanary technique I shot the backseat rear window with a less lethal shot gun. Joshua began to obey commands and finally gave up by surrendering peacefully. Once taken into custody the VIN number for the vehicle was ran through NCIC and showed to be stolen out of Albuquerque Police Department. While a search of the vehicle was being conducted a firearm was located where Joshua was seen reaching and had immediate control of. The firearm was a Taurus 9MM G3C. The firearm was ran through New Mexico State Police dispatch which showed to be stolen and firearm that was reported stolen with the vehicle. A further search of the vehicle found blue in color pills that my training and experience I could identify as fentanyl pills. Joshua was read his Miranda rights where he agreed to be questioned. Joshua stated that he was given the car by friends. Joshua stated he only knew the female that ran by “Bunny.” Joshua stated he was a convicted felon and knew he was not supposed to have firearms. Joshua stated he did think of using the firearm. Joshua stated he was a user of any drug he could get his hands on. The original female driver was never located after an extensive search of the area. The firearm and narcotics secured and photographed, it was stored in a lock box, and taken to the New Mexico State Police office where it will be placed into evidence. The vehicle was towed by Eagle towing and towed to the Eagle Towing tow yard. The registered owner contacted and informed where to retrieve there vehicle from.
