Police held a press conference Wednesday, sharing the body-worn camera footage of the shooting where an officer fatally wounded a suspect on Christmas Eve. Authorities initially responded to Murray Street around 8:30 a.m. following a 911 call reporting an armed man in the area. That's where they found the suspect, now identified as Todd Novick, 46, of Rochester, who can be seen talking briefly with the responding officer before running off and pulling out what appeared to be a handgun. The officer then opened fire, striking Novick at least once in the upper body. Novick was taken to Strong Memorial Hospital, where he later died from his injuries. During Wednesday's presser, Rochester Police Chief David Smith said the weapon pictured below, which was recovered from the scene, turned out to be a replica. "Under our general order and New York State Penal Law, officers are justified to use deadly physical force in defense of themselves or others," Smith explained. Smith said it wasn't possible for the officer to know the gun was a replica in the moment. "To expect an officer in those split seconds to differentiate 'what is it?' Especially since he didn’t throw it and run away — it was in his hand," he said. "What was his intention? We don’t know.” The officer involved remains on administrative leave pending the outcomes of investigations by the New York State Attorney General's Office and the Rochester Police Professional Standards Section (PSS).
