In Carroll v. United States (1925), the Supreme Court established the "automobile exception" to the Fourth Amendment's warrant requirement, allowing warrantless searches of vehicles if law enforcement has probable cause to believe they contain evidence of a crime, due to their inherent mobility. On March 12, 2025, officers with the Key West Police Department responded to a call in reference to subjects camping inside of a vehicle. Upon initially driving by the vehicle, the driver seat was unoccupied. As the officer approached the vehicle, she smelled a marijuana odor. In the end, officers located multiple edibles, concentrated cannabis wax, and marijuana. Aaron, the 38-year-old male, was charged with possession of marijuana over 20 grams, resisting an officer without violence, and two counts of possession of a controlled substance without prescription. Angelia, the 20-year-old female, was charged with possession of marijuana over 20 grams and resisting an officer without violence. Their cases remain ongoing. Aaron's charges: 1.
