In the early morning hours of December 15, 2022, Delray Beach Police Officer Nicholas Windsor stopped a 2018 Volkswagen Passat after observing unsafe lane changes on the northbound entrance ramp to I-95 at West Atlantic Avenue. Breath test results reportedly showed BAC readings of 0.124%, 0.152%, and 0.150%, all above the legal limit for drivers under 21. She was charged with driving under the influence, reckless driving, and turning without or with improper signal. According to court records, the DUI charge was later nolle prossed and the improper signal charge was dismissed. Averie pleaded guilty to reckless driving and was ordered to pay a total of $708.50 in fines.
