On September 10th, 2023, at approximately 2010 hours I, Officer Matthew St Martin with the Florida Fish and Wildlife Conservation Commission (FWC) was on foot patrol at the Sebastian Inlet State Park. I conducted a resource inspection of a fisherman returning from fishing. The fisherman was identified by his Florida driver’s license number (redacted) as (redacted) TATE, DOB (redacted). During the resource inspection, I asked Mr. Tate if he had any luck today, Mr. Tate stated he had a snook. Mr. Tate pulled the snook out of a live bait container. I measured the snook on my agency-issued Check-It stick, the snook measured 32 and ¾ inches. In the state of Florida, it is illegal to harvest from the Atlantic region, or possess in the region, a snook that is less than 28 inches or more than 32 inches in total length. Mr. Tate claimed that he caught the fish and measured it on a kid’s measuring device and when he measured it, he claimed it measured 31 inches. I advised Mr. Tate that if he could go and find the measuring device, he measured the snook on, I would compare the two. Mr. Tate came back empty-handed and then explained that now he remembered that he did not pinch the tail and that he was too excited at the moment which led him to forget to pinch the tail. I explained to Mr. Tate that it is illegal to harvest and or be in possession of a snook that is less than 28 inches or greater than 32 inches.
