Hillsborough Township, NJ On 2-04-2023 at approximately 3:57 am, I responded to the area near Wertsville Rd for the report of a disabled motor vehicle called in by the driver. After introducing myself, Abigail immediately stated that while driving west on Wertsville Rd an unknown vehicle crossed into her lane of travel causing her to veer to avoid hitting it. Abigail stated that she did not know what she hit but her front right tire had "flipped." I then asked Abigail where she was coming from that evening, and she stated from a friend's house. While speaking with Abigail, I could smell the strong odor of an alcoholic beverage emanating from inside of the vehicle and requested a second unit to respond to my location as well as a tow for the vehicle because it was disabled. While speaking with Abigail, I observed her speech to be slurred and slow, and her movement to be slow as well. While standing next to the vehicle, I observed spit or vomit to be on the outside of the driver door to be fresh and still wet. At this time, I asked Abigail if she had any alcohol to drink at her friend's house, to which she stated she did not. I then asked her to recite the alphabet from the letter "C" to the letter "O" without singing it. Abigail's first attempt she stated, "C,D,E,E,0." on her second attempt she stated, "A,B,C,D,E,F,0,G,H,I,J,L,K,M,N,O,P,O." I then asked Abigail what her highest level of education was, and she stated she had a bachelor's degree. I then requested her to count backward from the number 75 to 56. Abigail stated the following, "75, 74, 73, 72, 71, 70, 69, 69, 68, 67, 65, 67, 65, 64, 63, 62, 61, 60, 59, 58, 57, 56, 55, 54" before I stopped her from continuing. I then asked Abigail to step out of the vehicle, and I observed a large amount of vomit on the inside of the driver door and floor. When Abigail moved to the front of her vehicle, she again recited the story of the vehicle crossing into her lane and causing her to veer to avoid it. Based on my observations and Abigail's performance of the Field Sobriety Tests, I placed Abigail under arrest for driving while intoxicated. Abigail was handcuffed behind her back, double locked, searched and placed in the rear of patrol unit #607. I then conducted a search of Abigail's vehicle for intoxicants which yielded negative results. Cpl. Brown remained on scene and waited for towing to arrive and remove the vehicle in accordance with John's Law. While transporting Abigail, she only asked where she was being transported and that she had to use the bathroom. During the transport, I was stopped by Ptim. Kokinakos who had checked the area for any signs of an accident and found no concrete evidence of a recent crash and only observed the debris from Abigail's vehicle in the roadway. Upon arrival at HTPD headquarters, when I removed Abigail from the rear compartment, I could detect the strong odor of an alcoholic beverage emanating from the compartment that was not there prior to Abigail being placed inside. Abigail was led into Booking Room #2, searched again, and secured to the booking room bench. During this time, Ptim. Polacik read the NJ Attorney General Standard Statement for Motor Vehicle Operators for which Abigail refused to provide a breath sample. Refer to Ptlm. Polacik's Alcotest Operators Supplemental Report for further details. At this time, I advised Abigail of her Miranda Rights for which she understood and invoked her right not to speak any further about the incident tonight. She was charged with: 39:4-50 Driving While Intoxicated 39:4-96 Reckless Driving 39:4-50.4A Refusal to Submit Chemical Breath Samples 39:4-97 Careless Driving __________________________________ All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
