On October 19, 2024, at approximately 11:50 PM, a deputy observed a severely intoxicated male harassing patrons at the local Oktoberfest in Lantana, Florida. The officer, in full uniform, approached the individual, later identified as Marcel, and clearly stated his position as a law enforcement official. Despite multiple warnings, Marcel continuously attempted to touch the deputies. The officer instructed him to refrain from physical contact and to arrange for a ride home. However, due to his intoxication, Marcel was unable to remember his address and became agitated, throwing his phone to the ground. He began to incoherently express that he was a good person, moving within two feet of the officer and poking him in the chest. When the officer attempted to detain him, Marcel resisted, which necessitated an arm bar takedown. Throughout the encounter, Marcel made repeated physical contact with the deputies, admitting to touching them on more than five occasions. Based on the investigation, the officer believed there was probable cause to charge Marcel with battery on a law enforcement officer and resisting without violence under Florida state statute. The sheriff's department subsequently transported him to the hospital for evaluation due to his high level of intoxication.
