On July 29, 2019 while patrolling the area of Walnut Grove, I observed a white pick up truck occupied by two male subjects that weren't wearing their seatbelts. I also observed that the vehicle had a cracked windshield. The vehicle was traveling on Highway 138 going towards Monroe. The vehicle stopped the red light at the intersection of Highway 81, and the vehicle was on the lane to go straight on Highway 138. When the light turned green, the vehicle immediately turn his left directional and made an improper left turn onto Highway 81 towards Loganville. I proceeded to follow the vehicle and attempted to conduct a traffic stop, but the vehicle failed to stop. The driver of the vehicle increased his speed, and passed another car on a double yellow line. The driver of the fleeing vehicle was unable to maintain it's lane, continued passing more cars in no passing zones, reached speeds up to 95 MPH in a 45 MPH zone. Then, the vehicle drove on the wrong side of the road and turned left onto Youth Middle School. The driver of the fleeing vehicle was clearly reckless and had no regard for the safety of the public. When the vehicle turned into the school, I noticed that there were a lot of people in what appeared a sport's practice. Due to the eminent danger and the complete disregard of the driver for the public safety, I performed a PIT maneuver while I had the opportunity. When I performed the technique on the vehicle, the vehicle spun out as intended. The driver's door opened and the driver fell out of the vehicle. At that point, the passenger got into the driver's seat to in an attempt to drive off. However, Deputy Martinez's and my vehicle were blocking the exit of the parking lot where the vehicle was and the passenger at that point raised his hands. Next, Deputy Martinez ran to handcuff the driver who was on the ground. I began giving verbal commands to the subject (the passenger) to get out of the car and get on the ground. The subject failed to obey my commands to get on the ground and began walking away from me and towards Deputy Martinez. Due to the non-compliance of the subject, I ran towards to subject and struck him with a flying knee in the torso, which made him fall to the ground. I continued giving verbal commands to the subject; however, the subject continued to disregard my commands and sat up. At that point, the subject still had the knife in his waistband and was not following my commands to get on the ground, so I attempted to kick him but I did not strike him. The subject then laid on the ground, where I was able to put hands on him to turn him on his stomach and place him on handcuffs. Then, Deputy Martinez retrieved the knife and holster from the subject's waistband and put it on the ground next to the car. At that point, I observed a black handgun laying on the grass exactly where the driver landed when he fell of the ground. Then Deputy Marzula arrived and he grabbed the handgun and was clearing it, when we noticed that the gun was loaded with one round in the chamber. I photographed the handgun and secured it in my patrol vehicle. EMS arrived to render medical assistance to the driver who was complaining of ankle pain. Also GSP, Trooper Rutlege, arrive on scene to investigate the collision (which was a Precision Immobilization Technique "PIT" Maneuver), an intentional act performed to end the pursuit. Trooper Rutlege issued a case number 46-005-2019. I identified the driver as Philemon Gray, who was transported to Piedmont Walton by EMS. I also identified the passenger as Terrill Banks and I was advised that Banks had multiple Felony Warrants. Also, I learned that Gray was Driving Under Suspension and that the license plate on the vehicle belonged to a different car. The license plate on the pick up truck was from the State of Louisiana, number N533802; which belonged to a 2019 Gray Nissan Sentra. I also saw a mini bottle of liquor in the driver's side door pocket. I took photographs of the driver's injuries and I uploaded them to this report. I also took photographs of the damage to both my patrol vehicle and the suspect's pick-up truck. Furthermore, I took photographs of the passenger's face and body to confirm he had no injuries caused by the use of force. The subject also advised me that he was fine and nothing hurt. Later, both subjects were booked at the Walton County Jail. I logged and dropped all the evidence at the Walton County Sheriff's Office Evidence drop box on property receipts 86758, 86759, and 86761. Warrants were taken for Philemon Gray for Seatbelt Violation, Improper Left Turn, Passing in No Passing Zones, Speeding 95/45, Driving on the Wrong side of the Roadway, Reckless Driving, Concealing the identity of a Vehicle, Felony Fleeing, and Possession of a Firearm during the Commission of a Felony. Warrants were also taken for Terrill Banks for Obstruction.
