Primary Officers report: At approximately 07:42am, I was patrolling near Santa Rosa when I received a call from NMSP dispatch in reference to assist the Santa Rosa Police Department attempt to locate a silver Mercury passenger car reportedly driving recklessly, swerving in and out of its lane of travel appearing to be possibly intoxicated. Santa Rosa PD originally received a call of an erratic driver which made this the second call on this vehicle. A Santa Rosa PD Officer and I located the vehicle and attempted a traffic stop on the vehicle on Lake Drive and Route 66, as officers approached the vehicle fled from marked PD units. Santa Rosa PD was actively pursuing the vehicle in town as I attempted to deploy tire deflation device on the fleeing vehicle on route 66 to no avail and eventually the driver traveled onto I40 westbound. Due to the pose threat of an intoxicated driver, I caught up to the vehicle westbound on Interstate 40 near mile marker 262. The vehicle was traveling approximately 110 mph in a posted 75 mph speed limit zone. Our emergency lights (red and white) and sirens were activated. The vehicle was actively fleeing while the traffic was moderate. The vehicle was failing to maintain its lane of traffic, the vehicle was passing other travelling motorist on the right and left shoulders and onto the median. Due to the driver’s erratic display of operating the vehicle it was clear he was placing the public in danger. Near mile marker 230 on I-40 westbound the vehicle actively crossed the median onto eastbound lanes of I-40 and began to travel against incoming traffic "WRONG-WAY” travelling westbound in the eastbound lanes of travel. At some point the vehicle went back onto the westbound lanes of travel and continued to flee recklessly. Near mile marker 219 westbound NMSP Officers positioned themselves to deploy tire deflation device to disable the vehicle and end the pursuit. The vehicle avoided the spike strips and again went “WRONG- WAY” westbound in the eastbound lanes of travel. The vehicle then went back onto the westbound lanes of travel and continued to flee recklessly. Near mile post 216 westbound the vehicle was travelling recklessly around a curve, lost control and wrecked causing the vehicle to roll at least 1 time off the roadway. I approached the vehicle and saw the defendant punching the windshield and kicking it and eventually crawl out of the windshield and then trying to open the back door attempting to flee on foot. I approached the driver and while detaining the defendant I detected an overwhelming odor of alcoholic beverage emitting from his breath and on his person. I observed the defendant had difficulty maintaining his balance. The defendant was very belligerent and yelling profanity at me, when I placed him in the backseat of my patrol car, he began kicking the window so hard it caused the top of the door to not close right. While the defendant spoke, I observed his words were slurred as he spoke. There were 2 female occupants in the back seat (one female was a minor 17 years old). The driver was identified as Patrick Chavez. The females stated Chavez knew Officers were attempting to stop him and he refused to stop. The females also stated they begged Chavez to stop and let them out of the vehicle, the females also stated they were in fear for their lives and thought they were going to die. But he refused to stop. Chavez was air lifted to UNMH hospital in Albuquerque (Bernalillo County) to be treated for injuries. While at UNMH Chavez became combative and battered a nurse at the hospital. Because of this, Chavez was sedated, and the nurse does want to press charges. While at the hospital I read Chavez his Miranda Warnings per the Miranda Ruling which he understood. I asked Chavez before sedation if he had any alcoholic beverages to drink which he stated he had a shot of Bacardi this morning at the Blue Hole and the bottle was inside the vehicle. I also conducted an inquiry on Chavez and dispatch informed me he had two active warrants for his arrest for Aggravated Fleeing a Law Enforcement Officer and traffic offenses. Chavez was ultimately cleared by medical personnel and booked into the Metropolitan Detention Center in Albuquerque, NM.
