RATON, NM - On February 4th, 2020 at 9:04PM, patrolmen with the Raton Police Department were called by an employee from a local gas station claiming that a man in a white truck hit their store then left the scene of the accident. When a patrolman arrived at the suspect's residence, the owner of the vehicle claimed that he had not driven the truck and claimed that he could not see damage from his vantage point. The patrolman informed the suspect that when the truck hit the store, there were parts of the truck that fell and remained on scene that matched his vehicle. The suspect claimed that he would retrieve his license to the patrolman, but never came back outside after shutting the front door to his residence. Three and a half hour later and into the next day, the responding patrolmen observed the truck driving too fast for conditions and spun his vehicle around after exiting from the same gas station from earlier. Upon confronting the suspect, the patrolmen began questioning him again for more information. The suspect continued to maintain innocence and said he had not been drinking at any point in the night. The suspect told the patrolmen that he had lost traction on the road prior to being pulled over at the gas station. The suspect consented to performing a standardized field sobriety test when asked by the patrolmen. During the horizontal gaze nystagmus test, the suspect was observed having lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and an onset of nystagmus prior to 45 degress in both eyes. The patrolman verbally communicated to the suspect that he displayed nystagmus in his eyes and asked if had been drinking alcohol or if he was under the influence of any narcotics. While the suspect was being searched, he told the patrolman that he was currently on probation. The suspect also told the patrolman that he had a curfew, but did not know the time. The patrolman began explaining the walk-and-turn test to the suspect. The patrolman observed that the suspect struggling to follow instructions and needed the steps explained multiple times. During the test, the suspect had to be told by the patrolman to turn around and walk back to the starting position as instructed. The suspect had difficulties counting during the one leg stand test including counting the number 18 twice, swayed while trying to balance, and did not lift his foot six inches in the air as instructed. The suspect did not perform the finger count test as instructed due to being unable to count in sequence while also completing more than three iterations of the test when instructed to perform three only. When asked to recite the alphabet from "J" to "V" without singing, the suspect performed the test as instructed. During the first attempt to count backwards from 77 to 56, the suspect was distracted by radio communications so the patrolman let him attempt the test again. On the second attempt, the suspect asked the patrolman multiple times when to stop counting. The patrolman stopped the test and spoke to the other patrolman on scene regarding the tests performed. The patrolmen agreed that the suspect was very likely impaired and that an arrest was warranted. The suspect was taken into custody and arrested for driving while intoxicated (DWI). He was eventually charged with aggravated DWI after yielded a breath alcohol sample of .16% during processing.
