WARD COUNTY, ND - After midnight on New Year's Day 2020, a man was pulled over for driving a vehicle with expired registration by a Ward County Sheriff's Deputy. During the investigation, the suspect's passenger and girlfriend revealed that he was driving her vehicle and a new address may be the cause of why the registration was incorrectly registered. After the deputy asked the suspect to help look for registration and the suspect continued looking straight ahead, the deputy asked the driver to come back to his patrol car for further processing of the situation. Once back at the patrol vehicle, the deputy informed the suspect that the main reason he is on patrol is for drunk driving enforcement. After the suspect consented to a field sobriety test, the deputy commenced a horizontal gaze nystagmus test. Upon completion, the deputy explicitly told the suspect that he noted nystagmus and involuntary jerking of the eyes. Next, the deputy instructed the suspect to recite the alphabet from "G" to "X" whereupon the suspect replaced the letters "S" and "T" with the letters "X" and "E," respectively. The suspect also stopped at the letter "V" instead of completing the exercise. The deputy then instructed the suspect to count backwards from the number 64 to 43. During the first attempt, the suspect's passenger interrupted the test as she was confused as to why the suspect was pulled over and why her boyfriend was still in the police cruiser. The deputy dismissed her and the suspect was instructed again on the test. The suspect failed to coherently count backwards and did not successfully complete the exercise. The deputy informed the suspect that North Dakota law required drivers to take a screening test and such a refusal will result in revocation of their license for 180 days. The suspect agreed to take the breathalyzer test and blew as instructed after several failed attempts. Before the last attempt, the deputy informed the suspect that if he failed the final attempt, the breathalyzer test would be marked as a refusal. The suspect registered a .206% BrAC in the field screening test. The deputy initiated a DUI arrest and transported the suspect to the Ward County Correctional Facility to be processed. Once at the station, the suspect performed a breathalyzer test and recorded a .190% BrAC and a .202% BrAC attempt. The suspect was charged with driving under the influence (DUI). After processing was completed, the suspect posted $75 bail and was released to his girlfriend.
