The driver, a 22-year-old woman, was identified during the stop. Officers noted unusual circumstances upon making contact with the driver and later located a piece of clothing belonging to her inside the vehicle. During the interaction, the driver declined to answer questions that could be self-incriminating but agreed to participate in standardized field sobriety testing. While attempting the one-leg stand test, the driver was unable to demonstrate an understanding of the instructions, prompting officers to discontinue the evaluation. Based on the totality of the circumstances, she was taken into custody on suspicion of driving while under the influence. After being transported to the police station, the driver declined to submit to an evidential breath test. As a result, the DWI charge was elevated to aggravated DWI under New Mexico law. She was also cited for speeding. The case remains under investigation. All individuals involved are presumed innocent unless and until proven guilty in a court of law.
