On January 8th, 2023, at approximately 3:00 am, Middleburg Heights Police officers noticed a black object in the center lane of the roadway, and upon getting closer they realized it was a stopped vehicle. The vehicle was fully stopped with no headlights or engine running at the time. The driver and passenger, both in a relationship, had both been drinking and had gotten into an argument. The driver stopped when the passenger threw the keys of the vehicle from the vehicle window. When officers arrived they spoke with both parties and began helping them search for the keys before finding them. After finding the thrown keys officers began their investigation for a DUI. The driver had difficulty providing a breath sample on the breathalyzer but got a reading after multiple tries. After taking a breath sample officers conducted a Field Sobriety Test, which the driver failed and was subsequently arrested. The officers then spoke with the passenger who was with the couple's pet dog informing him they would charge the driver and bring him and their pet to the hotel they were due to stay at that night. Before transporting the passenger and dog to the hotel the officer explained that he would have to sign a release form for his partner when they brought her to the hotel but it was his choice to sign the form. Officers later brought the driver to the hotel where the passenger had previously been dropped off.
