On September 17th, 2022, at around 12:54 am, an officer in Oklahoma was on patrol when he saw a silver vehicle turning with a broken third brake light. After seeing the officer behind him, the driver of the silver vehicle turned into a nearby parking lot. Quickly the officer activated his emergency lights to conduct a traffic stop of the silver vehicle. The suspect was arrested and later charged with DUI - Driving Under the Influence, Resisting Arrest, Driving with a Suspended License, Operating a Vehicle with Defective Equipment, Failure to Carry Security Verification, Possession of Marijuana, and Possession of Drug Equipment. #bodycam #arrest #entitled ~~~ Pennsylvania v. Mimms is a landmark decision by the United States Supreme Court that upheld the common law rule allowing police officers to order persons out of a vehicle during a traffic stop. The case arose in 1977 when Harry Mimms was pulled over for driving with an expired license plate. The police officer asked Mimms to step out of his car. When Mimms complied, the officer noticed a bulge in his jacket and, fearing it was a weapon, searched him. The officer found a loaded revolver and arrested Mimms for carrying a concealed deadly weapon. Mimms appealed his conviction, arguing that the officer had violated his Fourth Amendment rights against unreasonable searches and seizures by requiring him to exit the car without reasonable suspicion that he was armed and dangerous. However, the Supreme Court ruled in a unanimous 8-0 decision that the intrusion on personal liberty of requiring a driver to exit his vehicle is minimal. The Court found that the public interest in officer safety outweighed this minimal intrusion, especially given the substantial risk to officers during traffic stops. The officer had a right to ensure his own safety by having Mimms exit the car, and once the bulge was noticed, the officer had reasonable suspicion to frisk Mimms. As a result of this decision, it's generally permissible for police officers to ask drivers to exit their vehicles during a traffic stop, even if they don't have any specific reason to believe that the driver poses a threat. This decision was later extended to passengers in the case of Maryland v. Wilson (1997). ~~~ ** Disclaimer: This video content is intended for educational and informational purposes only.
