On May 7, 2026, law enforcement officers responded to a reported altercation near Port O’ Pints in Crescent City, California. A Crescent City Police sergeant located the reported suspect across the street at a Shell gas station and allegedly saw him run back toward the bar before entering a black Chevrolet Silverado. Officers later observed the truck traveling east on Harding Avenue. A Del Norte County Sheriff’s sergeant reportedly recognized the man driving the Silverado based on her previous contacts. Officers followed the truck into a nearby parking lot and conducted an enforcement stop. During the DUI investigation, the driver gave officers conflicting explanations about who had been operating the vehicle. He initially claimed that his niece had been driving but later reportedly stated that nobody had been driving the truck. Officers observed red and watery eyes, slurred speech and a strong odor of alcohol coming from the driver’s breath and person. The driver allegedly admitted consuming two alcoholic beverages at Port O’ Pints and rated the effects of the alcohol as a three on a scale of one to ten. During field sobriety testing, the officer observed several possible signs of alcohol impairment, including lack of smooth eye pursuit, sustained nystagmus, eyelid tremors and an inaccurate estimate of time during the modified Romberg test. The driver provided only one preliminary breath sample that reportedly registered 0.166%. A 0.166% reading is more than twice California’s legal limit of 0.08%. Officers attempted to obtain additional breath samples but were unable to capture another valid result. The driver was arrested on suspicion of violating California Vehicle Code 23152(a), driving under the influence of alcohol. Because officers were unable to obtain an evidentiary breath sample, he was transported to Sutter Coast Hospital, where a blood sample was collected and submitted to the California Department of Justice for testing. The California Department of Corrections and Rehabilitation authorized an arrest under California Penal Code 3056 for an alleged parole violation. CHP recommended an additional charge under Vehicle Code 23152(b) if the pending blood test confirmed a blood-alcohol concentration of 0.08% or higher. The driver was booked into the Del Norte County Jail on the following charges: California Highway Patrol Officers involved: Officer Urteaga ID - 23445 Officer D. Johnston ID - 24318 Crescent City Police Department Officer involved: Sergeant Lopez ID - S1 Del Norte County Sheriff's Department Deputy involved: Sergeant Ashbury ID - 3S4 All persons are presumed innocent unless proven guilty in a court of law. 0:00 Police Response to Bar Altercation 2:12 Field Sobriety Testing Begins 4:39 Discussing Medical History 7:33 Questioning About Alcohol Consumption 11:45 The One-Leg Stand Test 15:13 Requesting a Breathalyzer Test 31:56 Frustrations During Testing #police #chp #california #bodycam #delnorte
