Eatontown, NJ On Friday, July 28, 2023, at approximately 1819 hours, witness Nicholas contacted the agency, reporting an incident involving the accused vehicle, a gray 2021 Honda Civic. Nicholas observed the vehicle leaving Guido's Pizza parking lot, traveling south across Broad Street, and colliding with bushes in the McDonald's parking lot. The vehicle continued through the parking lot and was last seen heading south on State Highway 35. Nicholas, positioned at Wolcott Park, witnessed the accused vehicle entering the park, and its driver, Dacotah, exiting the vehicle. Concerned about Dacotah's apparent intoxication, Nicholas promptly contacted the agency to report the motor vehicle crash. Paragraph 2: Initial Response and Interaction with Dacotah Responding to the report, on the same date and time, the responder arrived at Wolcott Park to find a damaged gray 2021 Honda Civic. The vehicle exhibited a damaged front bumper, a torn and flat front driver-side tire, and a missing rear wheel hubcap. Dacotah, the driver of the accused vehicle, was standing outside, facing north. Approaching the vehicle, the responder, with the patrol vehicle facing the driver side, attempted to gain Dacotah's attention. Dacotah, exhibiting signs of impairment, was slow to respond and initially unaware of the responder's presence. Upon interaction, the responder detected the odor of alcohol, observed slow and slurred speech, and noted Dacotah's disorientation. Despite requests for documentation and attempts to conduct sobriety tests, Dacotah became argumentative and uncooperative, refusing to comply. Paragraph 3: Enroute to Station Following Dacotah's refusal to perform sobriety tests, he was placed in the prisoner compartment of patrol vehicle 7 and transported to the Borough of Eatontown Police Department. The journey was marked by the persistent odor of an alcoholic beverage emanating from Dacotah. Paragraph 4: Processing at the Station Upon arrival at the police department, the responder assisted Dacotah out of the vehicle. Dacotah, displaying signs of impairment, required assistance walking and was taken to the prisoner processing room. Throughout processing, Dacotah remained argumentative, claiming unlawful detention and expressing a range of emotions. Breath samples were voluntarily provided, yielding a BAC result of 0.27% BAC. Once processing was complete, Dacotah's stepfather, Edward, responded to the police department, acknowledging and completing a Potential Liability Warning Form. Edward obtained custody of Dacotah. 5. TRAFFIC OFFENSES Dacotah received the following summons: 39:4-50 (Operating Under the Influence of Liquor) 39:4-97 (Careless Driving) 39:3-29C (Failure to Possess Insurance Card) 39:4-130 (Failure to Report Motor Vehicle Accident) 39:4-129B (Leaving the Scene of an Accident Involving Property Damage) 39:4-97A (Careless Driving; Operating a Motor Vehicle Causing Property Damage) 39:4-96 (Reckless Driving) 39:3-29A (Failure to Possess Drivers License) 39:3-29B (Failure to Possess Drivers Registration) 39:4-97.2 (Unsafe Operation of Vehicle) ______________________________________________ All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
