On September 19, 2024, a twenty three year old woman walked into a Montgomery County sheriff's office in Ohio on her own. Her sister drove her there. Her daughter waited outside. Two days earlier, someone had posted a threat on Facebook aimed at a high school in Harrison Township, and detectives had traced it to a phone. The phone was hers. There is no traffic stop in this one. No pursuit, no struggle, no street. It is one room, one camera, and forty seven minutes of conversation across a table, and it is worth your time for what that conversation turns into. She is read her rights line by line, initials each one, and signs the waiver on camera. Then a detective tells her there is an abundance of evidence, that it is not a matter of whether she did it, and that he only wants to know why. She says the same thing she will go on saying for the next half hour: that someone else made the account on her phone. She says it, in one form or another, ten separate times. About sixteen minutes in, she is told she is under arrest. She asks to call her mother. She asks to speak to her sister. Then she asks for a lawyer, twice, and says she is not going anywhere until she gets one. She is told she is going to jail. She asks again to call her mother and is told not right now, and that it depends on whether she decides to be cooperative. Nine seconds later she offers to keep talking. That is the whole film in about twenty seconds, and it is not the story people usually expect. She never changes her account. What changes is whether she will keep talking without a lawyer. Eighteen minutes after the interview ends, a deputy walks out to the parking lot, where her mother has been waiting. Her mother had driven up from Springfield. What she says to the detectives out there is the other half of this. Source agency: Montgomery County Sheriff's Office, Ohio. Records request MC24-8166. Reported charge: making a terroristic threat, Ohio Revised Code section 2909.23(A), a felony of the third degree. That section covers threatening to commit what the code calls a specified offense, which is mostly a violent felony, when it is done to intimidate or coerce a civilian population or to influence or affect a government, and when the threat causes a real fear that it is about to happen. There was no weapon in this case. The offense record lists the method as handheld computer equipment and the victim as society at large. The statute also says something worth reading in full: it is not a defense that the person did not intend to carry the threat out, or could not have. In Ohio a third degree felony of this kind carries nine to thirty six months. This is public police body camera footage obtained through a public records request. We add commentary and analysis explaining what is happening and the law behind it. The footage has been edited and condensed for length. The film opens on a sequence of short moments taken from across the interview, and each of those moments plays again in its place later; after the opening, the order of events is preserved. Profanity is muted. The names of people who are not charged, an email address, and a residential street address belonging to someone not involved have been removed from the audio. Dialogue subtitles are machine generated from the recording and can mishear a word. Names have been left out of the title, the thumbnail and the narration. We do not name her, we do not name the officers, and we do not name the person she accuses, who has not been charged with anything. Faces of children in the footage were redacted by the agency before release. We obtain footage like this through public records requests.
