SARATOGA SPRINGS, NY – On May 8th, 2021 at 11:51PM, an officer with the Saratoga Springs Police Department pulled a vehicle over that was unable to maintain lanes. After the officer spoke with the suspect, she specifically claimed that she had dropped a friend off before heading home. When the officer asked the suspect if she had anything to drink in the night, she explicitly stated that she does not drink and drive. The officer then asked the suspect to step out of the vehicle to which she complied. The suspect then claimed that she did drink earlier in the evening and had stopped at a local establishment before driving home. The officer then began conducting a field sobriety test. During the horizontal gaze nystagmus test, the suspect was observed having lack of smooth pursuit, nystagmus prior to 45 degrees, and distinct and sustained nystagmus at maximum deviation in both eyes. For the walk-and-turn test, the suspect stopped walking, stepped off line, completed an improper turn, missed heel-to-toe on several steps, and failed to remain in the starting position when instructed to do so. The suspect further swayed while balancing, used her arms for balance, and put her foot down several times for an extended period of time during the one leg stand test. At the conclusion of the standardized field sobriety test, the suspect was asked to recite the alphabet from "D" to "S." The suspect then recited the alphabet from "E" to "S." The officer then began to administer a preliminary breath test. Following several failed attempts from the suspect to provide a sufficient breath alcohol sample, the officer accepted the refusal by conduct. The suspect was then arrested for driving while intoxicated, or DWI. She was then transported to the Saratoga Springs Police Department for further processing.
