Deputies responded to a business in Martin County, Florida after employees reported a woman had struck herself repeatedly outside and had come back in after being asked to leave. Deputies made contact and spoke with her at length. She acknowledged injuring herself and said she had done so since she was a teenager. Deputies asked whether she had thoughts of harming herself further. She said she did not. Based on what they observed, deputies initiated a law enforcement Baker Act under Florida Statute 394.463, which allows an involuntary examination when a person appears to meet statutory criteria. Deputies told her repeatedly she was not under arrest. The situation changed at the receiving facility. Deputies said she had earlier shown them a Social Security card on her phone belonging to someone else, and she declined to unlock the phone or provide her name. Staff told deputies the facility could not admit her without a positive identification. A supervisor asked her directly to provide her name so she could remain and receive care. She declined. Deputies told her the options were the facility or jail. During the transfer she kicked an officer and was told she now faced a felony charge. She was transported to the county jail rather than admitted for the evaluation deputies had initiated.
