Police were called to the scene of a car crash where McVaney had collided with a building. McVaney was driving eastbound on S Maple St when he failed to navigate a left curve, causing him to veer off the road and crash into the northmost garage door of AFD Station 3. The impact also damaged the front end of a parked Med Unit, which was occupied at the time. McVaney was found near his vehicle when officers arrived. When questioned about the crash, McVaney admitted, "Well, I had a couple of beers and here we are." Officers requested McVaney's license and proof of insurance. McVaney claimed his insurance card was in the vehicle and allowed officers to search for it. Inside, officers found three open containers of beer—two Miller Lite and one Milwaukee Best—as well as a 1.7 oz bottle of 99 Bananas, all open. McVaney was then placed in handcuffs and taken to the 5th floor of the station for a breathalyzer test. He was presented with the BMV 2255 form at 23:52 and provided a breath sample showing a BAC of .144 at 00:00. McVaney was charged with Open Container in a Motor Vehicle, OVI, and Failure to Control. He was issued a summons and released
