A Miami-Dade Police Department officer in Miami, Florida was caught on camera blocking a public road at night with zero emergency lights on patrol vehicle 7402. No bodycam. No warning lights. No emergency. Just a taxpayer-funded law enforcement vehicle in a live traffic lane in Miami-Dade County while the officer claimed he was off duty. A citizen doing a cop watch spotted it, recorded the police encounter, confronted the officer calmly, and documented every second. The officer said four words nobody expected: YOU ARE ABSOLUTELY RIGHT. Vehicle 7402. Miami-Dade Police Department. Obstructing traffic without emergency lights. On record. On camera. Done. WHO WAS THE CITIZEN The man behind the camera is Rafael Antonio Gomez, known online as Ragomonkey, a Miami-Dade County based first amendment auditor documenting police encounters, law enforcement misconduct, and government accountability in South Florida for years. Covered by Miami New Times for his cop audit and cop watch work across Miami and surrounding Florida jurisdictions, Gomez is a citizen journalist exercising his constitutionally protected First Amendment rights in public spaces. WHERE AND WHEN THIS HAPPENED This police encounter took place in Miami-Dade County, Florida, USA in 2024 during a nighttime cop watch operation. The Miami-Dade Police Department, now restructured as the Miami-Dade Sheriff's Office as of January 2025, patrols one of the most populated counties in Florida and the entire USA. THE LAW THAT WAS VIOLATED Under Florida Statute 316.072(4), all traffic laws apply to law enforcement vehicles unless officers are actively responding to an emergency with lights and siren engaged. No emergency here. No lights. No authorization. Under Florida Statute 316.126, any emergency vehicle stopped on a road must have emergency lights on. The officer admitted the citizen was right on camera. That admission is the entire case. WHAT HAPPENED AFTER This was not Gomez's first run-in with Miami-Dade law enforcement. At NW 7th Street and 47th Avenue in Miami, Florida, Officer Heredia Rubio previously unlawfully handcuffed Gomez and his partner. Miami PD internal affairs confirmed the unlawful detainment. Miami-Dade Police had also flagged Gomez with a Law Enforcement Officer agitator alert, confirmed in a federal court order tied to a 2020 traffic stop lawsuit filed against Miami-Dade. As of 2026, no lawsuit or settlement has been publicly reported tied to the vehicle 7402 incident. No detainment, no arrest, no charges. The Miami-Dade Sheriff's Office has continued facing scrutiny over cop watch and first amendment audit encounters through 2025 and 2026. The City of Miami has paid over 13.5 million dollars in more than 300 police misconduct settlements since 2010. Police accountability is major news across Miami, Fort Lauderdale, Tampa, Jacksonville, and Orlando. WHY THIS MATTERS This cop watch video proves knowing your rights and staying calm works. From Miami, Florida to Los Angeles, California to New York, Texas, Chicago, Georgia, Arizona, Nevada, Ohio, Pennsylvania, Michigan, North Carolina, Washington, Colorado, Virginia, and Tennessee, cops in every city and state in the USA are subject to the same laws they enforce on you. No lights. No emergency. No excuse. Agency: Miami-Dade Police Department, Florida Vehicle: 7402 Law: Florida Statute 316.072 and 316.126 Date: 2024 Outcome: Officer admitted violation on camera, no arrest, resolved on scene DISCLAIMER This video is for educational and informational purposes only.
