Officer was behind a dark colored Chrysler Pacifica van. While stopped at the traffic like at the aforementioned intersection, the driver of the vehicle flicked ash from a cigarette out of the window of the vehicle in violation of OCGA 40-6-249. Officer continued to follow the vehicle eastbound and as it passed Fairfield Circle, The vehicle drifted from the left lane, across the dazed white center line of the roadway without signaling, and then quickly moved back into the left lane. The vehicle was driving right around the speed limit and at several times, below the speed limit, in the left lane. The vehicle did not move to the right to allow me to pass required by OCGA 40-6-184. Near the intersection of Atlanta Hwy and New Jimmie Daniel road officer activated his emergency lights. The Vehicle once again drifted out of the left lane into the right lane. Officer activated his siren and the vehicle changed lanes, moving from the left lane into the right lane. The vehicle continued to travel eastbound at a low rate of speed. Near the intersection of Park west Blvd, the driver threw a cigarette out of the window of the vehicle. The vehicle came to a stop near the intersection of Atlanta Hwy and Commerce Blvd. Officer approached the driver and asked to see her drivers license. The driver's speech was slurred and officer observed the odor of adult beverage coming from the passenger compartment of the vehicle. The driver struggled for a few moments to get her driver's license from her wallet. Officer asked the driver where she was coming from and she said "I was coming from the Brave's game." Officer asked driver how much she had to drink tonight and she said, "I had a glass...three glasses of wine before the game and then I went and watched the game and then I ate dinner." The driver handed the officer her license and was identified as Mary Cooley. Officer asked Cooley to exit the vehicle and she did. Cooley's Criminal History shows that she was charged with DUI in Saint Petersburg, Florida in March of 1997 and she was charged with DUI again in Milledgeville, Georgia in January of 1995.
