On September 6, 2025, Las Cruces Police Officers responded to a traffic collision involving an overturned vehicle. The driver that caused the accident was a 47-year-old woman who claimed to be a driver for Lyft. EMS personnel advised police that the woman had slurred speech and smelled of alcohol. When she was medically cleared, Officer Martinez approached the woman, who was still sitting in her badly damaged car. She was instructed to exit her vehicle and she was asked to perform standardized field sobriety tests. She was placed under arrest and was transported to the Las Cruces Police Station. Despite 3 separate attempts, she could not provide an adequate amount of breath for a valid breath test. She was charged with (1) Aggravated Driving While Under the Influence of Liquor; (2) Failure to Exercise Due Care (resulting in a collision); and (3) Failure to Possess a Driver's License. The outcome of her case is unknown.
