Seconds after repeatedly yelling “Drop the gun!” to a man he was chasing down a city street, a Paterson police officer on June 11 fired two shots and one of the bullets struck the fleeing suspect in the back, inflicting a non-fatal wound. Those events unfolded in a police body camera video made public late Friday afternoon by the Passaic County Prosecutor’s Office. Authorities said the shooting remains under investigation and that the case eventually will be presented to a grand jury. The prosecutor’s office on Friday identified the officer, Jerry Moravek, and the man he shot, 28-year-old Khalif Cooper. Moravek has been placed on paid administrative leave, according to the police union. He has been a member of the Paterson Police Department since 2014. Cooper has not been charged with any crimes in this incident, according to the prosecutor’s office. “Why did you run from me?” Moravek asked Cooper as they waited for an ambulance. “I was scared,” said Cooper, laying handcuffed on the ground, his white hoodie stained with blood. “I don’t got no gun though,” he added. About two minutes later, the video showed Moravek searching the pavement with his flashlight, then saying he successfully found a gun near the curb. “We trust the process and we’re glad there’s body camera video that shows what really happened,” said Moravek’s lawyer, Pat Caserta. “I’m confident my client complied with the policies and training of the Paterson Police Department, the Attorney General’s Office and the applicable law.” When asked about the fact that Cooper was shot in the back, Caserta declined to speak about the details of the incident. “In general, the law does permit officers to fire at fleeing suspects under appropriate circumstances,” he said. The president of one of Paterson’s police unions and the founder of the city’s Black Lives Matter (BLM) group both watched the video on Friday after getting it from Paterson Press. Union president Mason Maher said Moravek faced “an imminent threat” and protected himself and other people in the area by shooting the alleged gunman. BLM leader Zellie Thomas said he doesn’t think the cop should have fired his weapon because the man was running away from him at the time. “Just because he may have had a gun doesn’t mean he should be shot on the street,” Thomas said. “From what I can see it doesn’t appear he an immediate threat to the officer or anyone else.” Maher said there have been instances when armed suspects in foot chases have turned and fired at officers or shot over their shoulders at their pursuers. “None of our officers want to have to fire their weapons at somebody,” Maher said. Just prior to the shooting, two other Paterson police officers had seized a gun and arrested another 28-year-old man on Garrison Street in the city’s 1st Ward, the prosecutor’s office said. Moravek was dispatched to the scene prior to the arrest at 3:20 a.m. and activated his body camera while still in his patrol vehicle. For about two minutes, the video shows Moravek on Garrison Street as other cops arrested the other man and found the gun he allegedly had. Then three gunshots rang out. “Shots fired,” Moravek yelled as he ran towards the sounds. After about 15 seconds, the video shows a blur of white running in the opposite direction from Moravek. The cop suddenly changed direction and chased a man in a white hooded sweatshirt. “Drop the gun, drop the gun, drop the gun,” Moravek shouted, before firing two shots. Cooper fell to the pavement, next to a parked SUV. Moravek quickly placed him in handcuffs. “I don’t got no gun,” Cooper said again and again. Moravek urgently called for an ambulance. Several minutes later, Moravek searched the area. “Gun recovered here,” he said. “Where is it?” asked another cop. “Right here,” Moravek replied.
