DARLINGTON, WI - On June 16th, 2020 at 8:05PM, an officer for the Darlington Police Department recognized a subject from prior interactions at a local gas station who was operating a vehicle with a suspended license. After the officer activated his emergency lights, the driver continued to travel towards his residence a few blocks away from the initial traffic stop attempt. While investigating the suspect, the officer claimed that his K-9 unit would alert him to any suspicious odors. The suspect claimed that he had marijuana in his center console and that he had smoked prior to leaving his house. The officer observed that the suspect had slow speech and bloodshot eyes. The officer then asked if the suspect would be willing to participate in field sobriety tests to which the suspect consented. During the horizontal gaze nystagmus test, the officer observed zero clues. The suspect's eyes converged normally as well. For the walk-and-turn test, the suspect missed heel-to-toe on the third step and stepped off line on step four of the first set of steps. The suspect also lost balance while turning and stepped off line. The officer did not observe any clues on the one leg stand test. For the modified Romberg balance test, the suspect questioned whether the tests were necessary and claimed that ten minutes had passed after only a short duration. The officer then told the suspect that he did not have to perform the remaining tests if he would not take them seriously. During the second attempt of the modified Romberg balance test, the suspect had distinct eyelid tremors and estimated the passage of 30 seconds in 18 seconds. During the finger-to-nose test, the suspect placed his finger below his nose on the first attempt with his right hand. On the third attempt with the right hand, the suspect started to bring his left hand up before realizing that was incorrect. At the conclusion of the field sobriety test, the suspect was given the opportunity to call his roommate and place his groceries in the front porch of his house. The suspect was then handcuffed and arrested for operating while intoxicated, or OWI. The suspect eventually agreed to providing an evidentiary chemical blood sample and was transported to the Memorial Hospital of Lafayette County for a blood draw.
