On April 20, 2025, Las Cruces Police Officer Dutton stopped a vehicle for allegedly running a red light. The vehicle was being driven by a 29-year-old woman who admitted to consuming two 12-ounce Smirnoff Ice beverages earlier in the evening. As a result, she was asked to step out of her vehicle in order to perform standardized field sobriety tests. After the tests, she was placed under arrest and transported to the Las Cruces Police Station. She agreed to provide breath samples, but they registered 0.000% BAC. A Drug Recognition Expert (DRE) conducted an evaluation on the woman and determined she was impaired. Off camera, a blood sample was collected. She was charged with (1) Driving While Under the Influence; (2) Running a Red Light; (3) No Proof of Vehicle Registration; and (4) No Insurance. In addition, the woman was arrested for outstanding traffic warrants. The outcome of her case is unknown.
