On May twenty fifth, two thousand and twenty two, officers with the Clark County Police Department responded to a Target store in Athens, Georgia after Hank Blair Wittenberg, an elderly man identifying himself as a United States Navy veteran, was reported to be yelling racial slurs at customers and staff near the pharmacy. Officers attempted to de-escalate. Wittenberg refused every exit offered. He then spat directly into the face of Officer Young, a Black female officer, while directing racial slurs at her. He was handcuffed, fitted with a spit mask, barred from the store for two years, and transported to jail. During transport he continued the racial abuse, directing the n-word, watermelon references, and slavery imagery at Officer Young while she drove. The jail refused him for medical reasons. He was transported to the hospital under arrest and then returned to custody. He was charged with disorderly conduct and simple battery on a law enforcement officer. This video breaks down every legal decision point in the interaction, examining disorderly conduct and the fighting words doctrine under Chaplinsky versus New Hampshire, battery via spitting and its elevation when the victim is a law enforcement officer under Georgia Code Title sixteen, the hate crime sentencing enhancement under Official Code of Georgia Annotated Section seventeen dash ten dash seventeen and how Wittenberg built the prosecution's case for it himself, the excessive force standard under Graham versus Connor and why the spit mask was lawful mandatory safety equipment, the legal process when a jail refuses a medical intake, and what Officer Young's composure under sustained racial abuse means for the legal integrity of the case against him. We also address what this video is really about. Not Wittenberg's toe. Not his Navy service. Officer Young. And the standard of professionalism this job demands from people who are given every reason not to meet it. Nothing in this video constitutes legal advice. We are not practising attorneys. All commentary is for educational and analytical purposes only. Channel. Proof On Record
