He saw a 2004 Chevrolet pickup truck run a stop sign. The driver also made an improper turn near Kirk Street and Esmond Road. Toro turned on his lights, and she pulled over on Valmont Avenue between S Hastings Way and Fairfax Street. Toro spoke with the 21-year-old driver, Thea, and asked where she had been. She first said she was at the 5 O'Clock Club and the Alibi Lounge. Later, she said she had left work at the Smithtowne Pub. During the conversation, Toro smelled alcohol and noticed other signs of impairment. When he asked how much she had consumed, Thea first said she had not been drinking. She then admitted to having one Tito's. Her account of the evening did not make sense. Officer Noah Baumgarten of the Altoona Police Department arrived to assist. Toro returned to his squad car to check Thea's information, while Officer Margaret Andersen also came to the scene. Suspecting Thea was impaired, Toro asked her to step out of the truck and perform sobriety tests. He began with the Horizontal Gaze Nystagmus test, watching Thea's eyes as they followed his movements. Her eyes did not move smoothly, and they jerked at the outer edge. The jerking began before her eyes reached a 45-degree angle. Toro saw no vertical movement. Thea then attempted the Walk and Turn. She failed to touch heel to toe on several steps, missed the line, and made an improper turn. She also raised her arms to steady herself. During the One Leg Stand, she failed to lift her foot correctly, put it down several times, and could not complete the test. After the field sobriety tests, Thea refused a breath test. Her poor driving, signs of impairment, admission to drinking, and failed tests led officers to arrest her for OWI. Before Andersen took Thea to her squad car, Toro searched her. Officers moved Thea's truck to the AutoZone parking lot instead of having it towed. While Andersen completed her paperwork, Thea vomited, with most of it landing inside the patrol car. Andersen read her the Informing the Accused form, but Thea again refused to provide breath samples. Because Thea was on probation, Andersen placed a hold on her for booking into jail. She then took Thea to the Eau Claire County Jail. At 2:51 AM, Thea provided jail staff with a preliminary breath test sample, which showed a BAC of 0.225%. She received citations for OWI, making an improper left turn, and failing to stop at a stop sign. If you enjoyed this BodyCamBust video.
