Colts Neck, NJ "I approached the passenger side of the vehicle and made contact with the driver, Peter. Peter rolled down his passenger side window, and I immediately detected an odor of an alcoholic beverage emanating from within. Furthermore, I observed an odor of vomit. While speaking with Peter, I observed vomit on his person and coating the inside of the driver-side door. I asked Peter if he was having a medical emergency in which he denied. I asked Peter what was going on, and he advised he did not know. I asked Peter his name, and he advised his name was Peter. While speaking to Peter, I observed his eyes to be bloodshot and watery, his movements were slow, and he was speaking incoherently. I observed that Peter had two black eyes while I was speaking to him. I instructed Peter to turn off the vehicle. Peter struggled to do so but eventually was able to turn it off. I then instructed Peter to exit the vehicle. Peter attempted to stand up and out of the vehicle; however, the driver-side door was still closed, and he was seat-belted in. At this time, Ptl. Ferlisi arrived on the scene in a backup capacity. Peter then took his foot off the brake, and the vehicle began to roll backward. Peter eventually put his foot on the brake. I then instructed Peter to put the car in park, in which he motioned to the keys in the ignition. As a result, I entered the passenger side of the vehicle and put the vehicle in park myself. I made my way to the driver side of the vehicle and instructed Peter to step out of the vehicle. Peter said "no" and "why" to this request. At this time, I observed a half empty Tito’s vodka bottle, estimated to be 1.75 liters, on the front passenger side seat underneath a piece of luggage. In addition, I observed damage to the wheel of the front passenger side of the vehicle. I advised Peter to step out of the vehicle or he would be placed under arrest. Peter attempted to exit the vehicle, but it was locked. Peter unlocked the vehicle and opened the driver side door. He then stuck one foot out of the vehicle and attempted to hoist himself up utilizing the steering wheel as support. Peter then attempted to use the top of the driver side door to lift himself up out of the vehicle, almost closing the door on himself in the process. I asked Peter how much he had to drink tonight, in which he replied "nuttin" and then switched his answer to "maybe". Peter attempted to exit the vehicle numerous times but was unable to. I asked for Peter's license, registration, and insurance card, but he was physically incapable of doing so. I then transported Peter to CNPD headquarters with the starting and ending mileage logged, and the MVR recording for the duration of the transport. Ptl. Hoffman remained on scene with the vehicle, with Branning's as the tow for John's Law. During the transport, an odor of an alcoholic beverage and vomit filled the interior of my patrol vehicle. Upon arrival at headquarters, Ptl. Ferlisi and I assisted Peter out of the rear of my patrol vehicle. Patrols observed urine where Peter was sitting prior. Peter admitted to urinating himself in the vehicle. Patrols then assisted Peter towards the entrance of headquarters; again, he wobbled and swayed side to side. Peter would have fallen without patrols' assistance. Once we reached the steps into headquarters, Peter was unable to walk up these steps. While doing so, Peter began to lean forward and appeared to be falling asleep. Peter flailed his arms, striking me in my left temple with the handcuff, causing pain and a small laceration in this area. I felt a cold touch of steel with a serrated edge indicative of the handcuff's serrated edge. Patrols then brought Peter to the ground in an attempt to gain control of him. We fell backward over the chair, and Peter continued to push against my weight, attempting to remove me from his person. I was able to pin Peter's left arm to the ground and straddled his torso so he could not push up against me. I then removed myself from Peter while patrols secured the handcuffs in the front. I advised Peter he was now being charged with resisting arrest. While at the hospital, Ptl. Hoffman and Ptl. Ferlisi advised Peter was combative with hospital staff, and he had to be sedated. Due to the sedation, Peter was unable to give consent for a blood draw. After getting a warrant for a blood draw, his final BAC was reported as 0.111%."
