On Saturday, May 11, 2024, at approximately 08:50 AM, Officer K. Bouvier was dispatched to Circle K, in response to a call about a trespasser. The Reporting Person (RP) informed Key West Police Communications that there was a man in the store refusing to leave. Upon arrival, Officer Bouvier met with the RP, later identified as the assistant manager of the store, who reported that he had instructed a man to leave the store, but the man refused to do so. The assistant manager also showed Officer Bouvier the area where the man he asked to leave had opened a can of beer and poured it out onto the counter and multiple display cases of candy. Officer Bouvier observed an open can of beer on the counter, as well as multiple boxes of candy covered in a liquid consistent with the smell and consistency of beer. The assistant manager informed Officer Anglin that the dollar amount of the ruined product was $93.41. The assistant manager identified the man sitting outside the store as the suspect who refused to leave the property and damaged the candy display and products. The man identified by the assistant manager as the suspect was Blake Parker. The assistant manager requested that Blake be arrested for trespassing and destroying merchandise at the counter. The manager provided a sworn written statement regarding the incident. Blake appeared extremely intoxicated, having trouble standing and walking, with red, glassy eyes, slurred speech, and a strong odor of alcohol on his breath and person. Due to Blake's high level of intoxication and hostility towards officers, Officer Bouvier was unable to ask him any questions regarding the assistant manager's allegations. Blake was handcuffed and placed in the rear of the patrol car. Based on the assistant manager's sworn written statement and Blake's level of intoxication, Officer Bouvier believed probable cause existed that Blake had violated Florida Statute 810.09(2)(B) - Trespass Fail to Leave Upon Order of Owner or Authorized Representative. Additionally, based on the assistant manager's sworn written statement, the physical evidence observed, and Blake's level of intoxication, Officer Bouvier believed probable cause existed that Blake had violated Florida Statute 806.13(1)(B) - Criminal Mischief $200 or Less. Blake poured beer onto multiple boxes of candy, ruining them and making the product unsellable. The value of the damaged product was $93.41.
