GRAND FORKS, ND - At 2:24AM on January 18th, 2020, University of North Dakota Police observed and pulled over a vehicle traveling the wrong way near 3500 Gateway Drive. The officer asked the suspect where he was going to which driver responded, "home." The officer told the suspect that he could smell the odor of alcohol and asked him to step out of the vehicle to participate in a field sobriety test (FST). While stepping out of the vehicle, the driver staggered and used the door for balance. Beginning the FST, the suspect stated that he did not have any medical conditions that would affect his vision or balance. During the horizontal gaze nystagmus test, the suspect was swaying back and forth and moved his head several times even when instructed not to do so. Due to poor weather conditions, the officer moved the suspect to the back of his patrol vehicle to continue with other tests. While in the back of the patrol vehicle, the officer instructed the suspect to recite the alphabet from "E to T." The suspect had no issues with this test. When asked to count backwards from 59 to 38, the suspect stumbled on 49 - 48 and had to repeat 49 before continuing. The last test conducted was the finger count which the suspect completed as directed. At that point, the suspect consented to a preliminary breath test (PBT) and submitted a .204% BrAC sample. The suspect was subsequently arrested for driving under the influence (DUI) with a breath alcohol content of greater than .16%. This was the suspect's first DUI offense.
