On October 19, 2024, a deputy was conducting a proactive patrol in the area of State Road 100 in Palm Coast, Florida. During the patrol, a gray sedan with Texas license plates was observed leaving the parking lot of a local bar. While following the vehicle, the deputy noted that the license plate was not visible from a distance of 50 feet, the brake lights activated multiple times at a green light, and the vehicle crossed over the solid white line on the left side of its lane. After finding a safe location, the deputy initiated a traffic stop on State Road 100. Upon approaching the driver's side, the deputy made contact with the driver, identified himself and his agency, and explained the reason for the stop. The driver was asked to present his license, registration, and insurance. While the driver was locating the requested documents, the deputy observed signs of drowsiness, watery eyes, a lack of focus, and the smell of alcohol emanating from the vehicle. The driver provided an identification card from Nevada and claimed that his license was valid. The deputy returned to his vehicle to verify the status of the license, and upon consulting the Flagler County Communications Center, it was confirmed that the driver's license had been revoked. The deputy then requested the driver to exit the vehicle. Initially, the driver refused and began to argue. After being advised of the legal consequences of failing to comply, the driver continued to resist until the arrival of another officer prompted compliance. Once outside the vehicle, the odor of alcohol was still present. The driver was asked to submit to field sobriety exercises, which he refused. He was informed that refusal would lead to an arrest based on the deputy's observations. When instructed to place his hands behind his back, the driver tensed and attempted to pull away, leading to a struggle. The deputy maintained control and assisted the driver to the ground, where he continued to resist before being secured in handcuffs and placed in the rear of the patrol vehicle. Based on the observed indicators, the deputy believed the driver was under the influence of alcohol or narcotics, impairing his ability to operate a vehicle safely. The driver was arrested on suspicion of DUI and resisting without violence, and a DUI citation was issued. The driver complained of an injury and was taken to a local hospital for medical clearance. While there, he spontaneously admitted to resisting law enforcement but ultimately refused treatment and was transported to the county inmate facility without incident.
