IOWA CITY, IA - At 2:07AM on New Year's Day, 2020, an Iowa City Police Officer pulled over a woman who remained at an intersection after more than one cycle of the traffic lights then went over a crosswalk at the following intersection. The suspect admitted to having come from a bar and consuming "not much" alcohol. The suspect elaborated and admitted to having one alcoholic beverage. The suspect displayed difficulties producing her registration and proof of insurance so the officer obtained the appropriate documentation from her wallet himself. The officer then asked the suspect to step out of the car to perform field sobriety tests. The suspect was asked whether she had any vision problems that would affect her abilities to perform any of the tests. The suspect affirmed that she had no medical issues and that she could proceed with the officer's instructions. During the exercise, a second officer was asked to tell hecklers to be quiet such that the suspect would not be adversely affected by distractions while the test took place. The suspect consistently moved her head while following the officer's finger during the horizontal gaze nystagmus test. The suspect was unable to follow the officer's finger smoothly and distinct nystagmus was observed when her eyes were at maximum deviation. The suspect was asked by the officer if she would prefer to take the next test inside the gas station or outside in the parking lot. The suspect elected to move inside for the walk-and-turn test. Once inside, the officer asked again if the suspect had any medical problems that would affect her ability to walk in a straight line. The suspect told the officer of issues unrelated to walking and agreed to proceed with the exercise. While demonstrating the test to the suspect, the officer observed that she had to place her hand out to balance herself while standing in the starting position. The suspect did not once touch her heel to her toes and displayed poor balance and labored walking throughout the exercise. Upon completion, the officer had the suspect perform a one leg stand test. The suspect was not able to balance while counting, started the test by counting silently, did not say, "one-thousand," as instructed, and arbitrarily stopped the test once she could no longer balance on one leg instead of continuing until hearing the officer's instructions to stop. The officer observed the suspect grasping a nearby shelf for balance, stopping the test, then continuing to count once told not to count further. Following the test, the suspect performed a preliminary breath test and had difficulties having the breathalyzer detect her alcohol content as she was not blowing hard enough. The suspect stated she felt no effects from consuming alcohol. After the first successful screening, the officer told the suspect that she had blown almost twice the legal limit to drive in Iowa. The suspect was then arrested for operating a vehicle while under the influence (OWI). Once in the police cruiser, the suspect had difficulty understanding what her options were and repeatedly asked not to go to jail. The officer explained to the suspect that she had to be transported to jail prior to having someone bail or bond her out of police custody.
