SUMNER, TREMPEALEAU COUNTY, WI - On December 27th, 2020 at 7:35PM, a driver was observed crossing over the center line and driving into a ditch. Osseo Police responded to the call and witnessed a vehicle on the side of the road begin pulling away upon their approach. When the officer pulled over the driver, he waved him to pass. When asked for registration and insurance, the suspect continued to give the officer registration several times. The suspect repeatedly denied drinking alcohol. The officer then asked the suspect to step out of the vehicle. The suspect told the officer that he was tired and had been driving for Amish people while being awake for the last 36 hours. The suspect was then placed in the officer's patrol vehicle until a deputy arrived. The suspect asked to leave the patrol vehicle to go to the bathroom to which the officer obliged. Once the deputy arrived, the suspect asked if he was going to jail. The officer asked the suspect if he would perform field sobriety tests to which the suspect refused. The suspect also refused the preliminary breath test (PBT). Following the refusal, the officer and deputy arrested the suspect and searched his vehicle. The deputy found a bottle of vodka that was 3/4 full while the officer found less than one gram of marijuana in a container. The vodka was dumped on the side of the road and the marijuana was confiscated with the intention of disposing. The officer later completed an affidavit and search warrant to obtain a blood sample from the suspect. The officer was sworn in by an on-call Court Commissioner and the warrant was granted. The officer transported the suspect to The Mayo Clinic in Osseo where the suspect's blood was drawn. The suspect's blood sample result yielded .214 g/100mL ethanol. The legal limit to drive in the State of Wisconsin is .08 g/100mL ethanol. The suspect was charged with operating while intoxicated (OWI, 5th or 6th), refusal to take a test after arrest, and driving with an open container.
