Offenses: DUI - Adult beverages - Under 21 YOA - Concentration 0.02g Report: On 10/23/2021, Officer was on patrol headed south on Ave by Athens Orthopedic center when officer passed a parked vehicle with its driver's side door ajar and a young lady in a slumped position hanging out the side of the door. The vehicle was a 2015 Ford Escape. The vehicle was in an empty parking lot at a business that is closed at this time of the day. As officer approached the vehicle with his take down lights on, the driver of the vehicle closed the driver's door and attempted to drive off. Again attempting to approach the vehicle, the young lady driving parked the vehicle and quickly opened the driver's door exiting bending over as if she was going to vomit. Once officer was able to speak with the young lady he asked the young lady for identification, and she stated slurring her speech "Hold up, redacted" She was still being over as if she had to vomit continued to ignore my attempts to get her identification from her. After several attempts at trying to get her I.D. the young lady finally reached in the middle console of the vehicle and handed the officer her license. Officer was able to identify the young lady as Jocelyn Kethley. Ms. Kethley stated still slurring her speech that she was just getting off of work, and coming from a bonfire. Ms Kethley remained in a slumped over position as if she was going to vomit the whole time speaking to her. Ms Kethley was asked about her working closing at 7pm and that it was currently 2 o'clock in the morning, Ms Kethley kept stating that she was aware, but had to work with (redacted). Ms. Kethley stated over and over that she was attending a bonfire at two different locations, but kept reacting and changing the location back and forth. Ms. Kethley stated that (redacted) for the last two days and had to work. After speaking with Ms. Kethley and smelling the smell that is consistent with Adult beverages officer expected that Ms. Kethley may be intoxicated. Officer asked Ms. Kethley if she would consent to voluntary standard field sobriety test to see if she was safe to continue driving. Ms. Kethley consented to SFST's Horizontal Gaze Nystagmus test: Officer asked Kethley to stand straight with her feet together and her arms down by her side during the test. Officer told Kethley during the test to keep her head straight, and to follow his pen with her eyes only. Officer could not get any clues from the horizontal Gaze Nystagmus test. Ms. Kethley kept squinting her eyes during the test. Walk and Turn test: Officer asked Kethley to put her hands down by her side, and place her left foot heel to toe in front of her right foot. Officer demonstrated to Kethley how she should stand but Ms. Kethley placed her right foot heel to toe in front of her left foot. ● Kethley could not keep balance during instructions ● Kethley stopped during the test ● Kethley didn't touch heel to toe ● Kethley stepped off line ● Kethley used arms for balance ● Kethley performed improper turns ● Kethley took the incorrect number of steps Kethley had 7 out of 8 clues for the walk and turn test. One Leg Stand Test: Kethley had 3 out of 4 clues for the one leg stand test. ● Kethley Swayed her arms ● Kethley used her arms for balance ● Kethley put her foot down Officer placed Ms. Kethley in custody (DL/BB) and read her Georgia implied consent 21 and under for breath. Ms Kethley consented to breath and results for her breath was 0.168. The Vehicle was searched and a two empty bottles. Once bottle 1.75L and the other bottle 750mL was found in the backseat of the vehicle under the driver's seat. Kethley results from the test was 0.168, and refused to give a second sample.
