***Bentonville, Arkansas (Walmart National Headquarters Location)*** On October 30, 2022, at 23:01 hours, dispatch advised there was a drunk driver being reported by a member of Crystal Bridges security at 600 Museum Way. The reporting party advised that there was a "heavily" intoxicated male who appeared to be getting ready to drive away from the establishment. The male had been a guest at a wedding. The reporting party stated the male, later identified as Derek Stamps, DOB 12/10/1987 had gotten into an altercation in the parking lot earlier. Security advised that Derek had started the truck and provided the vehicle description, a black Chevrolet Silverado with two flags in the back, with Arkansas license plate ACL97H. Security identified Derek as a white male with grey hair. Observations Officer Logan Cornelison, #961 responded to the scene and made it to the main parking area. Dispatch advised the vehicle was leaving now, heading east toward J street. Officer Cornelison caught up and observed a black Chevrolet Silverado traveling eastbound on Museum Way. The vehicle displayed Arkansas ACL97H with a placard below indicating "Public Property." There was some type of fabric in the bed of the truck that appeared to be flags. The vehicle took the first exit on the roundabout traveling south on Northeast J Street. Officer Cornelison initiated a traffic stop on the vehicle that came to a stop at the Children's Enrichment Center on Northeast J Street. Officer Cornelison approached the driver and recognized him as Derek Stamps, a Jail Lieutenant at the Benton County Sheriff's Office. Officer Cornelison was supervised directly by Derek at the sheriff’s office. Officer Cornelison identified himself and retrieved Derek's information. Derek responded to Cornelison when he identified himself, saying, “I know who you are.” Officer Cornelison could smell the odor of intoxicants in Derek's vehicle. When asked if he had anything to drink, Derek responded, initially stating he hadn’t but changed his story to only beer. Due to Officer Cornelison's previous work history with Derek, he passed on the investigation to avoid a conflict of interest. Officer Cornelison did note, however, that Derek's behavior was off, and he appeared lethargic. Officer Cornelison reiterated his slowed and slurred speech. When I arrived on scene, I asked Derek if he would be willing to let me verify the Standardized Field Sobriety Test conducted previously by Officer Tatum Alred, #957. Derek stated that he would. Derek did not satisfactorily complete field sobriety testing. Arrest Derek was arrested for Driving While Intoxicated, (05-65-103). I placed Derek in handcuffs, searched his person and escorted him to Officer Cornelison’s patrol car to be transported to the Bentonville Police Department. I followed behind Officer Cornelison. During this time Officer Tatum Alred, #957 conducted a tow inventory of the vehicle. The inventory included (02) pistols in the center console, (01) pistol and badge in the driver’s door, (01) plate carrier, (06) 40 MM rounds, a black bag containing (01) gas mask and (07) boxes of 9mm ammo, and (01) rifle magazine loaded with 5.56mm rounds. The vehicle was towed to the Benton County Sheriff’s Office. Booking Once at the Bentonville Police Department I read Derek the Arkansas Statement of Rights. I asked him if he would consent to a breath analysis, he consented. Derek’s final test result was a .15. Derek’s driver’s license was seized, and he was issued the Administrative License Suspension Form. Derek then had his personal information updated and photograph uploaded for the case. During this time Derek changed his initial story from just having one beer to having a little bit of wine. I issued Derek citation E149275 for Driving While Intoxicated, (05-65-103) with a mandatory court date of December 06, 2022, at 07:30 hours. I then transported Derek to the Benton County Jail to be held on a sober hold. Additional Information Page: 4 of 5 Case Number: 2022-00038307. ORI: AR0040100.Officer Cornelison called the reporting party, back to gather further information. Jared advised that earlier in the night, a supervisor informed him that there was a disturbance in the parking lot between Derek and another intoxicated male. Jared identified Derek as being the more intoxicated of the two. The other party left for the evening shortly after. Jared kept an eye on Derek after the altercation via CCTV. Jared described Derek as "stumbling around" and leaning on other guests to maintain his balance. Jared also noted Derek struggled to walk down the stairs. Jared's supervisor asked Derek if he had a ride home. Derek stated he did, but soon after, Jared observed Derek walking to his truck in the parking lot. Jared called dispatch to report Derek as a drunk driver
