-Boise, ID. -February 22, 2022. According to a recent news release, the Gem County Prosecuting Attorney's Office determined the actions of the Boise Police officer who shot and injured Jonathan Manee on Feb. 22, 2022, were justified under Idaho law The prosecutor reviewed the officer's on-body video and the complete investigation conducted by the Ada County Critical Incident Task Force. On Feb. 22, 2022, a BPD officer attempted to help a driver standing on the road near West Fairview Avenue and North Liberty Street. Witnesses reported to dispatch that the driver was causing a traffic hazard and might need help. Officer Cody Evans responded to the call and pulled up behind the subject's vehicle, which was stopped in the left turn lane on Fairview. The driver stood by the passenger door waving and talking to passing drivers. Shortly after arriving and contacting the subject, Jonathan Manee, Officer Evans changed the call type to 'Crisis' due to the irrational statements Manee was making. Officer Evans attempted to escort Manee out of the roadway for his safety, but Manee resisted, pulled a handgun out of his pocket, and pointed it at Officer Evans. The Gem Country Prosecuting Attorney said after reviewing Officer Evans' body camera, the facts are not disputable. "While behaving abnormally in the roadway and within physical touching distance of Evans, Manee pulled a handgun out of his pocket and aimed it directly at Officer Evans," said Erick B. Thomson, Gem County Prosecuting Attorney. "Evans responded by drawing his own weapon and firing at Manee twice, hitting him, and then immediately provided medical aid to Manee. The actions of Officer Evans were justifiable under Idaho law." Manee was treated and released from the hospital. He was charged with and convicted by a jury in June 2023 of Aggravated Assault upon a law enforcement officer with a Deadly Weapon enhancement. On Monday, Aug. 28, 2023, Manee was sentenced to serve up to 25 years in prison with 15 years fixed before being eligible for parole.
