IOWA CITY, IA - At 2:29AM on New Year's Day 2020, an Iowa City Police Officer pulled over a driver for having her driver side taillight out and expired registration on her vehicle. The suspect struggled to provide the requested documentation for the officer which prompted him to ask how much she had had to drink for the night. The suspect claimed that she had four beers from 7PM to 11PM. When asked to step out of the vehicle, the suspect had difficulties balancing. The suspect confirmed that she had no vision problems and had no medical problems with her eyes when the officer asked. During the horizontal gaze nystagmus test, the suspect moved her head throughout the exercise after being instructed not to do so. The suspect was unable to follow the officer's finger smoothly and asked if she had to follow the officer's finger. The suspect struggled to follow basic instructions from the officer and stumbled before attempting the walk-and turn test. The suspect became belligerent and did not attempt the test. After stumbling, the suspect asked the officer if she could go to jail "now." The suspect also asked the officer if he was ICPD after the officer had told the suspect that he was once the traffic stop was initiated. During the one leg stand test instructions, the suspect once again became belligerent and would not attempt the test. After several opportunities were given to the suspect to attempt the test, the suspect continued to interrupt the officer and claimed to be unable to perform the test without a cigarette. The officer allowed the suspect to forgo testing and blow into a breathalyzer to which the suspect consented. The preliminary breath test registered .168% breath alcohol content (BrAC). The officer informed the suspect that the result was over twice the legal limit to be driving in Iowa. The officer initiated an OWI arrest and transported the suspect to the Iowa City Police Station for further processing. While there, the officer read the suspect her Miranda rights and the suspect agreed that she would understand her rights after being told the results on the evidentiary breath test. At the station, the evidentiary breath test registered a .177% BrAC and the suspect was charged with operating a vehicle while under the influence (OWI).
